Rafael Villa, 31, of Idaho Falls, is scheduled to appear in court on Sept. 30 facing two felony counts of rape and other serious charges related to the sexual abuse of a 13-year-old girl. The amended complaint, filed on Sept. 15, significantly escalates the legal jeopardy for Villa, who was originally charged with felony lewd conduct with a child in July.
The new filing adds counts of felony sexual abuse of a child and felony intimidating a witness. If convicted on all charges, Villa faces a potential life sentence in prison. He has been appointed a public defender; the Idaho State Public Defender’s Office declined to comment on the active case.
Investigation Origins
The criminal investigation began in early 2022 after a school resource officer contacted the Idaho Falls Police Department on Jan. 6, 2022. The tip came from a friend of the victim, who had received a confession regarding the abuse.
Court documents indicate the friend reported that Villa lived with the victim and her mother during the Thanksgiving and Christmas breaks of 2021. The friend alleged that Villa groped the minor under the pretense of wrestling for a phone, an interaction that reportedly left bruises on the child.
Allegations of Assault and Intimidation
Police reports detail specific allegations of sexual assault occurring in late 2021. The victim alleged Villa sexually assaulted her on Nov. 21, 2021. Days later, she stated that Villa threatened her with physical violence to ensure she remained silent about the incident.
Around Dec. 3, 2021, the victim alleged a second rape. According to court records, Villa allegedly instructed the girl to fake her menstrual cycle following this second assault.
During an initial forensic interview, the victim did not disclose sexual contact. However, investigators downloaded data from the victim’s phone, which revealed search history including queries for “signs your pregnant.” On Jan. 12, 2022, an officer met with the mother and the victim to discuss concerns about a potential pregnancy. The victim allegedly told the officer she believed she was pregnant and suspected Villa was the father.
Suspect Interview and Arrest
An officer interviewed Villa over the phone on Jan. 7, 2022. Villa signed a Miranda Rights waiver during the call. He allegedly told the officer that the victim had claimed pregnancy but did not know who the father was. When the officer stated he believed Villa was the father, Villa denied having sex with the victim.
Court records show officers learned on Jan. 26, 2022, that the victim was not pregnant. Despite this finding, an arrest warrant for Villa was obtained on Nov. 15, 2022. The warrant remained unserved for nearly four years before being executed on July 20, 2026.
Court Proceedings
Villa’s initial court appearance is set for Sept. 30. The hearing will be presided over by either Magistrate Judge Wiley Dennert or Senior Judge James Howard Barrett Jr.
